GENERAL TERMS AND CONDITIONS OF SALE OF KUU ORO
1/REGISTRATION and PAYMENT
In accordance with Article L.121-20-4 of the Consumer Code, persons registered for a service do not benefit from the seven-day withdrawal period.

In the case of online booking, the acknowledgement of receipt of the reservation by e-mail summarises the contract offer, the reserved services, the prices, the cancellation conditions relating to the selected rate, accepted by the customer, the date of reservation made, the information relating to the after-sales service, as well as the address of the seller's establishment with which the customer can submit his claims. 2/MODIFICATIONS REQUESTED BY THE CUSTOMER
2.1 Cancellation: Cancellation fees (variable depending on the number of days prior to the service):
Change or modification of the service: The waiver of one of the services included in a service is not subject to any refund.
2.3 Modification during the service: In this case, the additional costs incurred are the responsibility of the participant.
2.4 Assignment of contract: In the event of transfer of the Registration File to a third party, the customer is required to inform KUU ORO no later than 7 days before departure by any means that allows an acknowledgement of receipt to be obtained. 2.5 Interruption of service: Following a medical repatriation by the assistance of the participant, unused services cannot be reimbursed.
3/MODIFICATIONS BY KUU ORO
3.1 Cancellation He cannot claim any compensatory indemnity. 3.2 Changes before departure Before departure, an itinerary, a program and a place of embarcation may be modified for weather reasons. The participant will therefore not be able to cancel without losing the entire price of the service.
3.3 Changes during the service KUU ORO may then be required to take charge of the additional services induced or to reimburse, except in cases of force majeure, the difference in price between the services provided and those provided.
3.4 Interruption of service: In this case, unless the interruption is due to a case of force majeure, KUU ORO will reimburse the price difference between the services provided and those provided.
4/ RESPONSIBILITIES
4.1 Civil Liability However, the liability of KUU ORO does not replace the individual civil liability of which each participant must be the holder.
4.3 Events outside of KUU ORO KUU ORO cannot be held responsible for the partial or total non-performance of the planned service due to events external to it and in particular in the event of: – incidents attributable to the participant (delay, absence, risky attitude, etc.) – incidents attributable to a third party, -Force majeure (unpredictable and insurmountable incidents or events such as: wars, political unrest, strikes, riots, climatic conditions, natural disasters, etc.).
4.4 Rules of caution KUU ORO reserves the right to exclude, at any time, one or more participants whose behaviour would endanger the safety of the group or its well-being, without any compensation being due to the offending participant.
4.5 Prerequisites and technical levels KUU ORO cannot be held responsible for any physical insufficiency revealed during the trip.
4.6 Minors Except during the services reserved for them, minors must be accompanied by at least one of their parents or any other adult authorised by them.
4.7 Transportation and accommodation before and after the service In the event of modification or cancellation of the service for the reasons mentioned above, KUU ORO is not responsible for any loss of the value of the tickets or accommodation services that the customer would have contracted to go to the place of commencement of the service and/or to return to his home after the service. KUU ORO therefore strongly recommends that the customer opt for modifiable and/or refundable tickets and accommodation services.
5/EQUIPEMENTS
5.1 Equipment provided The materials and equipment provided by KUU ORO are listed in the technical sheet or registration file of the corresponding service. They are entrusted to the participant who becomes responsible for them during the duration of the service. Any deterioration may result in repair or replacement costs. As such, the participant is advised to ensure that his personal liability insurance policy covers any damage caused during a sea kayak service. The participant is free to use his personal equipment under his own responsibility without being able to claim any reduction or compensation from KUU ORO.
5.2 Equipment to be Provided. The equipment to be provided is listed in the technical sheet of the corresponding service. It is important to control your equipment, the safety, comfort and smooth running of the service may depend on it. The customer is solely responsible for his personal equipment.
6/PRICE
6.1 Price and payment: The prices of KUU ORO services only include the transport, loan or rental of navigation equipment and the corresponding equipment. Ancillary costs: Most trips are clearly defined in their rates and the resulting ancillary fees are detailed in the registration files. Accommodation, catering and sometimes transport services during a trip are directly invoiced by the service provider or may be the subject of a common fund organised and advanced by KUU ORO. It is up to the customer to refer to the technical sheet of the chosen service to know the exact list of services included and the list of equipment to be provided. The prices of KUU ORO's services have been calculated as accurately as possible according to the economic conditions known at the time of printing its documentation. They are applicable from publication until the day of publication of the following edition. They have no contractual value and are confirmed to the buyer at registration. They are subject to possible changes that apply to all people already registered or wishing to register. Promotions and discounts are not cumulative or retroactive. The establishment has chosen ultinow.com/stripe.com to secure online payments by credit card. The validity of the customer's payment card is verified by stripe.com. There may be a refusal of the payment card for several reasons: stolen card, blocked card, ceiling reached, entry error... In the event of a problem, the customer will have to contact his bank on the one hand, the establishment on the other hand to confirm his reservation and payment method. In the case of a rate subject to online prepayment, the amount paid in advance, which is the deposit, is debited at the time of booking.
6.2 Small group supplement: In order to avoid cancelling a service for lack of a sufficient number of participants (see 3.1), KUU ORO can offer a small group departure for an additional fee. The customer is then free to accept or refuse. In case of refusal, KUU ORO will reimburse him for the amounts paid. If on the day of departure the size of the group reaches the minimum number required, the supplement becomes undue by the customer, it is, as the case may be, refunded or not claimed.
7/RESPECT FOR PRIVACY
Privacy is a topic that is at the heart of the booking platform's concerns. The customer is informed, on each of the personal data collection forms, of the mandatory or optional nature of the answers by the presence of an asterisk. The information processed is only intended for the establishment and online payment providers. This information is not passed on to other third parties. When paying online, the customer's bank details must be transmitted by the Stripe.com payment provider to the establishment's bank, for the execution of the reservation contract. The customer is informed that this data transfer can therefore be carried out in foreign countries that do not have adequate protection of personal data within the meaning of the Data Protection Act. However, the customer consents to this transfer necessary for the execution of his reservation. 8/CONTESTATION
